Terms and Conditions

Thank you for choosing Prickled & Posed Studio. Below is a general overview our policies and restrictions so we can ensure all renters have an enjoyable experience. All of the terms and conditions governing your use of the Studio. The terms and conditions contain limitations on our liability and other important provisions allowing us to provide the Studios at the price we do. RESERVATION
Your rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Reservation time must include set up, break-down, and clean up. The studio must be cleaned and vacated by the end of the rental period to respect our fellow creative’s time and efforts.

CHANGING YOUR RESERVATION (NO REFUNDS ON CANCELLATIONS)
You can change your reservation with no additional charge at any time 24 hours before your reservation is set to begin by contacting us. Upon rescheduling, you will be able to select a new future date for your selected session. We do NOT provide a refund on cancellations.

NO REFUNDS WILL BE ISSUED DUE TO CANCELLATIONS BY CLIENT.

RESTRICTIONS
• Children must be monitored AT ALL TIMES. Any damages done to our studios, or property by unsupervised children, will be held responsible at the renters expense.
• Flamed candles MUST be approved by us prior to rental.
• Fireworks (including sparklers) are prohibited.
• Our studio styled set ups are decorated as is. Renters are NOT allowed to bring their own decorations or furniture to alter/hang, or manipulate the set ups that are in place. Renters / Photographers are allowed to bring in lights, backdrops, or other photographer related equipment.
• Nails, tacks or staples may not be used in the walls or woodwork. If tape is used, it must be painter’s tape.
• Paint, silly string, and sand are NOT allowed.
• No tacks, safety pins, paper clips or any object that is sharp may be used on paper backdrops.
• Smoking/vaping is prohibited in the Studio and within 25 feet of all building entrances, exits, windows and air take vents. Projects involving smoke machines must have management approval prior to reserving the Studio.
• No illicit drug use is permitted, and the Studio reserves the right to terminate the reservation immediately without refund if such activity occurs.
• Set up and breakdown times must fall within the total reservation period reserved. It is the responsibility of the Renter and it's vendors to set up, breakdown, and move lighting equipment (if brought) and other items within the Studio.
• Renter may NOT sublease the Studio to any third party.
• The Prickled & Posed Studio / The Pierced Cactus Co may monitor all activities in the Studio and have the authority to enforce this Agreement. A representative may terminate the rental if you/client breaches this Agreement or applicable local law.

FURNITURE & PROPS
Renters are not allowed to alter/hang or manipulate the setups that are in place. Renters are allowed to bring lights, backdrops or other photography related equipment. Balloons are allowed in our studio room. All furniture that isn’t in use by styled set ups are available for renters use. All furniture and props must be returned to designated area.

DAMAGE AND CLEANING
You are responsible for any damages to the studio including spills, scratches, excessive wear, marks or stains on furniture, fixtures, floors, or painted surfaces. The Studio and all furnishings and equipment therein must be left clean and in good condition, normal wear and tear accepted. Trash should be in trashcans, equipment returned to its proper place, and any larger trash disposed of in the outside dumpster. If the Studio is not in the same condition when rented, Renter agrees to pay, as applicable (i) a minimum of a $100 cleaning fee (based on the amount of time required to clean the Studio at a rate of $100 per hour); and (ii) the cost to repair and replace any damage done to the Studio and the furnishings and equipment therein caused the you/client.

Once you (photographer/client) access the Studio, if you feel there is damage to any of the furnishings, equipment, or Studio we should be aware of, please contact us IMMEDIATELY.

Studio and property management are not responsible for theft or damages to vehicles or contents. Renters and clients must park in any designated concrete parking during sessions. DO NOT leave purses, bags or any other items of value in your car.

LENGTH OF USE
Rental periods are pre-arranged at the time of booking. Photographer’s/Client's rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Time includes set up and break-down. Property must be cleaned and vacated by the end of the rental period. No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless negotiated at time of rental contract. Additional fees may apply. Early or extended hours must be worked out and paid for in advance before rental period begins.

WAIVER OF LIABILITY
Use of The Prickled & Posed Studio Premises and equipment is at Photographer’s/Client's risk. Photographer/Client hereby agrees that The Prickled & Posed Studio will not be held liable for any direct, indirect, incidental or consequential damage, injury or loss to Photographer/Client, his party or possessions while on the Premises. Photographer/Client holds harmless and indemnifies The Prickled & Posed Studio and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury or damages, including reasonable attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental.

CONDUCT
This is a shared building and we maintain a professional environment. Photographer/Client shall be solely responsible for the conduct and welfare of all persons accompanying Photographer/Client while on The Prickled & Posed Studio Premises. Photographer/Client agrees that The Prickled & Posed Studio representative may, at The Prickled & Posed Studio sole discretion, be present at all times. If the representative observes or otherwise becomes aware of dangerous, pornographic, illegal or negligent practices or activities, the representative reserves the right to stop the shoot and may require Photographer/Client and Photographer’s/Client's party to leave immediately. The authorities will be alerted to any illegal activities witnessed by The Prickled & Posed Studio representative. In such case no refund will be given for unused time. However, The Prickled & Posed Studio and its representatives assume no responsibility to act in such cases.

AGE OF MODELS
Photographer/Client is solely responsible for verifying that all photographic subjects are of legal age or accompanied by a parent or legal guardian. The Prickled & Posed Studio has no responsibility to determine or verify the age of participants in the Photographer’s/Client's activities but reserves the right to demand proof of parental consent if models or photographic subjects are under the age of 18 and to end those activities if The Prickled & Posed Studio becomes aware that legal age violations are occurring. The Prickled & Posed Studio is not liable in the case of an invalid ID or any other form of age verification

DAMAGE
Photographer/Client shall be solely responsible for any damage to The Prickled & Posed Studio property or equipment that occurs during the time Photographer/Client or his party occupies the Premises. Photographer/Client agrees to pay reasonable repair costs to bring damaged equipment back to working condition. Photographer/Client agrees to pay for damage to the Premises including spills, excessive wear, marks or stains on furniture, fixtures or painted surfaces. Damages will be charged to the credit card on file. Cleaning fees will be charged to the credit card on file at a rate of $40 per 1/2 hour according to the time necessary to bring the space back to pre-rental condition.

LATE FEES
The photographer/client that books the space will be assessed a late fee. The late fee is calculated by how many minutes past the original reservation the photographer/client or The Group associated with the event leaves the space. The rate is $10/minute every minute past the original reservation. The card on file will be charged the late fee the following day.

REMINDERS
Before your rental end time in the studio:

Wipe down any tables if used.
Clean floors with our broom and dustpan (located in the bathroom).
Ensure all props and furniture is put back in place.
If you used any props that leave residue put contents in trash can that is provided in the bathroom. Ensure all trash is disposed of.

WHEN LEAVING THE STUDIOS
Within your rental time, make sure you leave the studio clean and tidy for the person after you. Make sure all the lights are OFF. ENSURE you lock the front door using the same steps you took when you entered. Close the door shut, then press the lock icon.

I HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS AND AGREE TO ADHERE TO THE POLICIES OF THE PRICKLED & POSED STUDIO SET FORTH HEREIN. 
Failure to adhere to these policies may subject to rental cancellation with no refund and/or additional fees. If management deems appropriate, access to rent The Studio may also be enforced. It is the desire of the parties hereto that these Terms and Conditions be enforced to the maximum extent permitted by law, and should any provision contained herein be held unenforceable, the parties hereby agree and consent that such provision shall be reformed to make it a valid and enforceable provision to the maximum extent permitted by law. These Terms and conditions shall for all purposes be deemed mutually drafted and prepared by the parties, and shall not be construed for or against a party based on which party drafted these Terms and Conditions or any portion thereof.
